Terms and Conditions for Citibank Online-Pakistan

Please read Citibank Online Terms and Conditions carefully as access and use of Citibank Online is subject to these Terms and Conditions. By accessing this Web Site or any pages thereof, the Customer unconditionally and irrevocably agrees to be bound by the Terms and Conditions. Citibank Online
1. Definitions


1.1. “Terms and Conditions/Agreement” means these terms and conditions and as amended/ modified by Citibank from time to time.

1.2. “I/We/Us/Customer(s)” means the customer of Citibank accessing and/or using Citibank Online.

1.3. “Citibank” means Citibank, N.A. Pakistan Branches.

1.4. “Citibank Online/Services” means Citibank internet banking services available and provided on this Site and the "Services" means the banking services available through Citibank Online from time to time which enable the Customer to obtain information and/or to carry out certain banking transactions/services pertaining to the Account(s) through computer, telephone, cellular telephone, personal digital assistant and/or any other electronic device linked to Citibank Online.

1.5. The “ATM PIN” refers to the four-digit password selected by the Customer for his/her Citibank Debit/ Credit Card. The Debit Card number is the sixteen-digit number embossed on the Customer’s Debit Card. The Credit Card number is the sixteen-digit number embossed on the Customer’s Citibank Credit Card. Citibank shall have the right, from time to time, to change ATM PIN and/or issue any other password or security mechanism for the purpose of the Customer’s identification to access Citibank Online/Citibank Alerting Services.

1.6. “Account(s)” means the saving account, current account, time deposits, Citibank Credit Card account, supplementary credit card account and/or any other account of the Customer maintained with Citibank or to which may be opened in the future by the Customer.

1.7. “Statement of Account” means a periodic statement/written confirmation issued by Citibank in relation to an Account containing details of transactions conducted during the preceding six months period or any period as requested by the Customer.

Card Statement of Account means a periodic statement/written confirmation issued by Citibank in relation to an Account containing details of transactions during the preceding one month.

1.8. “Site” means this Citibank Pakistan website www.citibank.com.pk as amended and modified from time to time by Citibank.

1.9 “User Name/Password/Challenge Answer” means Customer’s name submitted by the Customer at the time of accessing/opening Citibank Online, password means a confidential code containing combination of alphabets and numbers not less than 6 characters as selected/proposed by the Customer and confirmed instantly by Citibank through Citibank Online or any change in the password from time to time, and Challenge Answers are simple responses to five Challenge Questions selected by Customer at registration time. Customer will answer any one of the five Challenge Questions selected at the time of accessing/opening Citibank Online.

2.0 “Schedule of Charges” mean the latest schedule of bank charges issued by Citibank currently in effect.

2.1 “Facility” means the Citibank Online Services as offered by Citibank from time to time.


2. Customer's Acceptance


2.1. In consideration of Citibank making available the Services through Citibank Online, the Customer acknowledges having read, accepted and understood the following:

2.2. By accessing and/or using Citibank Online, the Customer has accepted and agreed to be bound by the Terms and Conditions herein stated.

2.2.1. The Customer irrevocably and unconditionally accepts as binding any Service availed and/or transaction and/or instruction made or given through Citibank Online at his/her own risk and responsibility. Citibank’s records of any transaction processed through Citibank Online shall constitute binding and conclusive evidence of such transaction for all purposes.

2.2.2. The Customer further acknowledge that any Services accessed or utilized through Citibank Online shall be subject to Citibank’s Terms and Conditions as applicable from time to time, including but not limited to any fees, expenses or charges relevant thereto as prescribed in the Schedule of Charges which Citibank may directly debit from the Customer’s Account(s).

3. Customer's Responsibility for Security

3.1. The Customer will be responsible to keep confidential his/her ATM PIN and User Name/Password/Challenge Answers and the same will not be disclosed to any other person and the Customer will safeguard it from being divulged and /or being used by any other person(s).

3.2. The Customer will immediately inform Citibank by calling on 111 222 222 if the Customer discovers or suspects that the ATM PIN/User Name/Password/Challenge Answers or any part thereof is known to someone.

3.3. The Customer will not allow any other person to operate Citibank Online on his/her behalf and the Customer will not leave his/her computer unattended during the time when the Customer is online. Neither will the Customer access Citibank Online from a computer connected to a local area network (LAN) n or from a computer in a public use or public internet cafe without ensuring that no one else is able to observe or copy his/her access or obtain access to Citibank Online.

3.4. The Customer will be responsible to comply with any other measures and requirements, which Citibank may advise from time to time.


4. Access and Use of Citibank Online

4.1. The Customer will only use Citibank Online on a computer or other Internet access device which the Customer owns or has rented. the Customer will not access and use Citibank Online on a computer or any other Internet access device which belongs to any other person or which is owned and provided to the Customer by his/her employer without such person’s, or his/her employer’s (as the case may be) previous written permission. Citibank will not be responsible for any loss, damage or harm caused to any person as a result of his/her not complying with this condition.

 4.2. Citibank will not be responsible if the Customer is unable to gain access and/or use Citibank Online due to reasons beyond its control, including without limitation, any computer, and telecommunication, electrical, technical or network failure/malfunction.

4.3. Citibank will, on best effort basis, make available Citibank Online for use; however, the Customer agrees and understands that the routine maintenance requirements, excess demand on the system and reasons beyond the control of Citibank may cause disruptions in the availability of this facility.

4.4. The Customer agrees that in relation to Citibank Online, by giving a notice to the Customer, Citibank will be entitled to:

4.4.1. change the mode of operation;

4.4.2. Add or remove or otherwise change the Services/facilities provided under this Site;

4.4.3. Close down temporarily or permanently Citibank Online.

4.5. The Customer will be responsible, at his/her own cost and expense, to ensure that his/her computer or any other device through which the Customer access Citibank Online is compatible with the service system used by Citibank. Citibank will not be responsible for any loss, damage or harm arising due to non-compatibility between Citibank systems and the computer or other device from where the Customer accesses Citibank Online.

4.6. The Customer will be responsible to keep the computer or other devices to be used to access and use Citibank Online safe and free from any computer virus and any similar programs/software and to ensure that they are adequately protected against acquiring computer virus.

4.7. The Customer is aware and agrees that Internet communications are not secure unless the data is being sent in an encrypted form. The Customer also agrees that Citibank will not be responsible for unauthorized access and use by a third party and/or corruption of data being sent through Citibank Online. Further, the Customer will acquaint himself/herself with the process/method of using facilities available on the Site and Citibank will not be responsible for any errors made by the Customer and/or other co-account holders.

4.8. Citibank Online is intended to be used by the Customer in Pakistan and in case the Customer accesses and uses Citibank Online from a foreign country or outside Pakistan in that event the Customer will be responsible to comply with laws and regulations of the same country/territory including without limitation obtaining any license required for use and import/export of the software/program used for Citibank Online to that country.

4.9. The Customer will be responsible for all claims, actions, damages or losses incurred by his/her Internet service provider in relation to the Customer accessing and using Citibank Online.

4.10. Joint Accounts: The Facility of Citibank Online will not be available to the Accounts held jointly by more than one individual.

5. Customer's Instructions for Services

5.1. Any instructions given to Citibank through use of Citibank Online and by using his/her ATM PIN and User Name/Password/Challenge Answers and the same instructions will be deemed to be given by the Customer and Citibank will be entitled to assume that the referred instructions are genuinely given by the Customer and the Customer will protect Citibank for acting on such instructions. Citibank will be entitled to act on the Customer’s instructions without any further written or other confirmation from the Customer, even if those instructions have not been actually given or authorized by the Customer. The Customer understands that Citibank is only providing the Customer the facility (without obligation) of carrying out the transactions in relation to his/her Account(s).

5.2. The Customer will be fully responsible for any instructions given to Citibank in relation to the Services available on Citibank Online and Citibank will not be liable in any manner for any unauthorized, fraudulent, or erroneous instruction and loss, damage and/or any other consequences arising as result of such unauthorized, fraudulent or erroneous instruction(s).

5.3. The Customer agrees that Citibank may, in its sole discretion, refuse to carry out any instructions if Citibank has reason(s) (in which the decision of Citibank will be final and binding on the Customer) to believe that the instructions are illegal. The Customer will check the Statements for all of his/her Accounts for any unauthorized transaction. In case of any discrepancy in details of any transactions carried out in respect of the Account, in that event the Customer will immediately inform Citibank in writing. Citibank will not be responsible in any manner if the Customer fails to notify Citibank to such effect within fifteen (15) days. In cases pertaining to Statement of Account relating to Credit Card(s), in the event that the Customer fails to notify Citibank of a discrepancy in respect of the State of Account within fourteen (14) days of the date of the Statement of Account, the transactions will be deemed as being correct and as having been accepted by the Customer.

5.4. The Customer understands and agrees that Citibank, in its discretion, by notice to the Customer, may withdraw or charge for the Services at any time. Citibank will not acknowledge receipt of any instruction given by the Customer nor shall it be responsible to verify any instructions. Citibank will endeavor to give effect to instructions on a best effort basis.

5.5. The Customer understands that no written advice or confirmation will be made and issued by Citibank for any transaction conducted on Citibank Online although such transactions will be recorded in Statement of Account as issued by Citibank periodically or as provided to the Customer on his/her request.

5.6. The Customer agrees that Citibank will not be liable in any manner for, including but not limited to, the following:

5.6.1. Any failure to act upon any instructions or to provide the Services for any reason that is beyond Citibank’s control;

5.6.2. Acting in good faith on any instructions received by Citibank;

5.6.3. Any error, default, delay or inability of Citibank to act on all or any of the instructions given through Citibank Online;

5.6.4. Loss of any instructions given by the Customer through Citibank Online;

5.6.5. Unauthorized access by any other person to any instructions given by the Customer through Citibank Online;

5.6.6. for any loss or damage that may arise or be incurred directly or indirectly by reason of Citibank carrying out his/her instructions and/or from any malfunction or failure of Citibank Online.

5.6.7. for any change, alteration, additions or deletions to these Terms and Conditions, the services, the systems of operation of Citibank Online, or the daily cut-off times;

5.6.8. for any partial, incomplete, late or failed transfer or bill payment to any payee nominated under the Services due to reasons beyond Citibank’s control;

5.7. Any information given by the Customer will be correct and Citibank will be entitled, without any obligation, to review or monitor such information for security, administration or any other purpose. Such information will be the property of Citibank and Citibank shall have the right to share such information with a third party for including but not limited to process transaction(s)/data.

5.8. Any instructions submitted through Citibank Online will not be affected and remain valid if operations of Citibank Online is suspended or comes to an end due to any reason.


6. Execution of Instructions/Transactions

6.1. On instructions given through Citibank Online, Citibank will be entitled to debit any amount along with the applicable charges/fees from time to time for the transaction from the Customer’s Account as instructed by the Customer. The instructions given on Citibank Online cannot be reversed. Citibank will not be responsible for any of the following:

6.1.1. To reverse an instruction given through Citibank Online;

6.1.2. To accept an instruction which is conditional or which requires Citibank to make payment to a third party earlier (or later) than the time Citibank requires according to normal banking practice.

6.2. Citibank, if justified in its sole discretion, will be entitled to refuse to carry out an instruction submitted through Citibank Online or may require the Customer to provide a written confirmation of such instructions.

6.3. Citibank will act on instructions in accordance with cut-off times as notified though Citibank Online or in absence of such notice as per the normal banking practices.

6.4. The Customer may be unable to obtain full value under a demand draft or manager's cheque or pursuant to a telegraphic transfer on account of exchange or other restrictions applicable in the country of payment or to the paying bank or charges and fees of the paying bank.

6.5. Purchase by Citibank of a demand draft or manager's cheque previously issued by Citibank will be at its discretion and transacted at its buying rate for the currency in which the draft or cheque is to be made in.

6.6. In the absence of special instructions, Citibank may convert all transfers to the Customer’s Account into the currency of the Account at Citibank's selling rate of the currency.

6.7. All transfers requested by the Customer will be converted by the paying bank in the currency at its buying rate unless the payee has made special arrangements with the paying bank.

6.8. Withdrawals and/or transfers of funds will not be permitted against uncleared funds.

6.9. Citibank will not be liable for any act or omission of any correspondent or paying bank or for any error or delay in transmission. The Customer agrees to indemnify and hold Citibank harmless against all losses, damages and expenses incurred by Citibank in relation to any demand drafts or manager's cheques issued by Citibank or any telegraphic transfers made by Citibank on his/her instructions.

6.10. If the manager's cheque or demand draft is lost, stolen or destroyed, the Customer will indemnify Citibank and agree to hold it free and harmless from all liability with respect to the lost, stolen or destroyed cheque or draft if Citibank agrees to issue a replacement cheque or draft, or refund the amount of the cheque or draft.

6.11. If the transfer authority is submitted through Citibank Online, Citibank may act upon such authority/instructions and may presume that the same are genuine and accurately represent the wishes of the Customer, even if the instructions are actually compiled or sent in error or by fraud or negligence or altered or amended by someone other than the Customer with or without the actual knowledge or instructions of the Customer. Citibank has no duty to verify the facts and genuineness of the instructions.

6.12. The Customer agrees to hold harmless and indemnify Citibank against any loss, cost, damage, expense, liability or proceedings which the Bank may incur or suffer as a result of Citibank acting upon or delaying to act upon or refraining from acting upon the said instructions.

6.13. On the Customer’s request, Citibank may provide to other co-account holder(s) the Citibank Online facility if the Customers have a joint Account(s) and in that case, the Customers will be jointly and severally bound hereunder and responsible to comply with the Terms and Conditions and all liabilities and obligations arising due to access and use of the Web Site either by any one of the Customers or by all co-account holders collectively.

6.14. The Customers also agree that any instructions given by any of the signatories/co-account holder(s) will be binding on all of the Customers/joint account holders and Citibank will not be responsible for any claim and dispute between the Customers.


7. Charges

7.1. Citibank will be entitled to:

7.1.1. Charge the Customer fees and service charges for access and use of Citibank Online;

7.1.2. Charge the Customer applicable fees and service charges for carrying out transactions on Citibank Online and such charges are notified in the schedule of charges issued by Citibank from time to time.


8. Liability for Loss or Damage

8.1. Subject to the Terms and Conditions and with prejudice to rights of Citibank hereunder, Citibank will take reasonably practicable steps to ensure that its systems in connection with Citibank Online are adequately secure and to manage and control the risks in operating the systems, taking into account all laws, regulations, rules, circulars, codes of conduct and good practices prevailing in the banking industry as applicable from time to time.

8.2. Citibank will not be liable for any loss or damage of whatsoever nature, whether direct or indirect or consequential, to the Customer including his/her successors, executors and administrators, as result of making Citibank Online available to the Customer, and such loss or damage may include without limitation the following:

8.2.1 acting on an instruction which has been validly authenticated as submitted by the Customer but which in fact was given fraudulently by a third person/party(ies);

8.2.2. Citibank Online being totally or partly unavailable for any reason;

8.2.3. Execution of the Customer’s instruction delayed or not being acted upon by Citibank;

8.2.4. The Customer’s reliance on the information provided and available on Citibank Online;

8.2.5. any access by a third party to information about the Customer’s Account(s) (except where the access is obtained due to gross negligence or willful default of Citibank and in that Citibank will only be liable for direct loss or damage to the Customer which in the ordinary course of events might reasonably be expected to result from circumstances in question).

8.3. the Customer will indemnify Citibank, its employees, agents, representatives and nominees on a full indemnity basis from and against all actions, claims, proceedings, demands, losses, damages, harms (including direct, indirect or consequential) costs, expenses, charges, taxes, penalties and legal costs and any other liabilities of whatsoever nature which Citibank may incur or suffer by reason of his/her accessing and/or using Citibank Online.

8.4. the Customer understands and agrees that all obligations of Citibank under these Terms and Conditions/Agreement and are sole responsibility of and are only payable by Citibank N.A. Pakistan Branches, subject to laws of Pakistan, and no other branches of Citibank outside Pakistan and/or affiliate or associated undertaking of Citibank/Citigroup shall be responsible in any manner to the Customer and/or any third party in such respect


9. Trademarks

9.1. Citibank, Citigroup and the Umbrella Device are trademarks / trade names of Citigroup and are used and registered throughout the world. The Blue Wave design is trade dress of Citigroup and is used throughout the world. Citibank, Citicorp, Citigroup and their subsidiaries also claim rights in certain other trademarks and service marks contained in these web pages and no third individual/party, whether incorporated or un-incorporated shall have any claim on the referred trade marks/names.


10. Use of Information and Materials

10.1. The Customer understands and agrees that the information and materials contained in these pages/the Web Site, and the terms, conditions and descriptions that appear may be changed by Citibank at its discretion. Unauthorized use of the Web Site and/or Citigroup's web sites and systems including but not limited to unauthorized entry into Citigroup's systems, misuse of passwords, or misuse of any information posted on the Web Site is strictly prohibited. All products and services may not be available in all geographic areas. The Customer’s eligibility for particular products and Services is subject to final determination by Citibank.

10.2. The Customer agrees that by making available Citibank Online to the Customer, Citibank is granting the Customer a non-exclusive, non-transferable, temporary license to use this Web Site and related software to use Citibank Online and this permission is restricted to authorized and legitimate access and use of Citibank Online. All materials and information and trade mark(s)/name(s) given in this Web Site belong to Citibank. In this regard the Customer agrees as follows:

10.2.1 Not use this information/material except in connection with accessing and using Citibank Online;

10.2.2. Not to make/take copies, sell, assign, commercially rent, sub-license or otherwise transfer the same to any third person;

10.2.3. Not attempt or decompose, reverse or tamper with the system/software related to Citibank Online.


11. Links

11.1. This Web Site may contain links to web sites controlled or offered by third parties (non-affiliates of Citigroup). Citibank hereby disclaims liability for any information, materials, products or services posted or offered at any of the third party sites linked to this web site. By creating a link to a third party web site, Citibank does not endorse or recommend any product(s) or service(s) offered or information contained at that web site, nor is Citibank liable for any failure of product(s) or service(s) offered or advertised at those sites. Such third party may have a privacy policy different from that of Citibank, and the third party website may provide less security than the Citibank Online.


12. No Warranty

12.1. The information and materials contained in this Web Site, including text, graphics, links or other items, are provided "as is", "as available". Citibank/Citigroup does not warrant the accuracy, adequacy or completeness of this information and materials and expressly disclaims liability for errors or omissions in this information and materials. No warranty of any kind, implied, expressed or statutory, including but not limited to the warranties of non-infringement of third party rights, title, merchantability, fitness for a particular purpose and freedom from computer virus, is given in conjunction with the information and materials.


13. Limitation of liability

13.1. In no event will Citibank/Citigroup be liable for any damages, including without limitation direct or indirect, special, incidental, or consequential damages, losses or expenses arising in connection with this Web Site or any linked site or use thereof or inability to use by any party, or in connection with any failure of performance, error, omission, interruption, defect, delay in operation or transmission, computer virus or line or system failure, even if Citibank, or representatives thereof, are advised of the possibility of such damages, losses or expenses.


14. Submissions

14.1 All information submitted to Citibank via this Web Site shall be deemed and remain the property of Citibank and Citibank will be free to use, for any purpose, any idea, concepts, know-how or techniques contained in information a visitor to this Site provides to Citibank through this Site. Citibank will not be subject to any obligations of confidentiality regarding submitted information except as agreed by Citibank having the direct customer relationship or as otherwise specifically agreed or required by law. Nothing contained herein shall be construed as limiting or reducing Citibank’s responsibilities and obligations to Customer in accordance with the Citigroup Privacy Promise for Consumers.


15. Availability

15.1 This Web Site is not intended for distribution to, or use by, any person or entity in any jurisdiction or country where such distribution or use would be contrary to local laws or regulations.


16. Additional terms

These Terms and Conditions are in addition to the terms and conditions applicable to the banking accounts and credit card terms and conditions and other terms and conditions which govern the services and consumer banking facilities provided by Citibank. In the event of a conflict between these Terms and Conditions and other terms and conditions, these Terms and Condition will prevail over other terms and conditions as far as issue or dispute relates to internet banking facility as provided through Citibank Online.


17. Miscellaneous

17.1. If any of the provision of the Terms and Conditions stated herein is unenforceable due to whatsoever reason, the other terms and conditions remain valid and will not affect enforceability thereof.

17.2 Any waiver or relaxation given by Citibank will not be construed as a waiver permanently, and such waiver will not affect adversely the rights of Citibank under this Agreement at any other time.

17.3 In case any provision of these Terms and Conditions becomes legally unsound in any way, the same fact will not affect validity of the other terms and conditions.

17.4 Citibank will have the right to change these Terms and Conditions at any time by giving a notice in such a manner as solely determined by Citibank.


18. Governing Law

18.1. These Terms and Conditions, access and use of Citibank Online shall be governed by applicable laws of Pakistan, and both parties to this Agreement agree to submit to the jurisdiction of courts in Pakistan. However, Citibank will have the right to pursue its remedies in and outside Pakistan and in the courts of any other jurisdictions which are considered appropriate.

The Customer understands and agrees that clicking/pressing the “I Agree” button appearing hereunder would signify that the Customer has read, understood and accepted to be bound by these Terms and Conditions. In the event the Customer clicks/presses the “I Disagree” button he will be returned to the Citibank Online homepage.
